2. Verification of Beneficiaries

The Department verifies the identity and eligibility of beneficiaries to ensure that only lawful heirs and dependants benefit from the estate of a deceased person. This process involves reviewing supporting documentation, conducting investigations where necessary, and confirming relationships in accordance with the applicable succession laws.

3. Conducting Family Meetings

The Department convenes and facilitates family meetings to guide beneficiaries and interested parties through the estate administration process. These meetings provide an opportunity to identify beneficiaries, discuss the composition of the estate, promote consensus on the appointment of administrators, and resolve issues amicably before formal legal processes are undertaken.

4. Issuance of Certificates of No Objection

The Department processes applications and issues Certificates of No Objection to eligible applicants seeking to obtain Letters of Administration from the courts. The certificate confirms that the Administrator General has no objection to the proposed administration of the estate after satisfying itself that the legal requirements have been met.

5. Administration of Estates

Where required by law, or where there is no suitable person to administer an estate, the Department administers estates on behalf of beneficiaries. This includes identifying and preserving estate assets, settling lawful liabilities, safeguarding the interests of beneficiaries, and ensuring that the estate is administered fairly, transparently, and in accordance with the law.

6. Supervision of Estate Administrators

The Department monitors and supervises individuals appointed as estate administrators to ensure that they perform their duties faithfully and in compliance with the law. It provides guidance where necessary, reviews the progress of estate administration, and takes appropriate action where administrators fail to fulfil their legal obligations.

7. Investigation of Complaints Regarding Estates

The Department investigates complaints relating to estate administration, including allegations of fraud, intermeddling, concealment of assets, mismanagement, unlawful occupation of estate property, and disputes among beneficiaries. Appropriate recommendations and administrative or legal interventions are made to protect the integrity of the estate and the rights of beneficiaries.

8. Recovery of Estate Property

The Department undertakes measures to identify, trace, recover, and preserve estate property that has been unlawfully occupied, transferred, concealed, or misappropriated. It works with courts, law enforcement agencies, local authorities, and other relevant institutions to restore estate assets for the benefit of the rightful beneficiaries.

9. Resolution of Succession Disputes

The Department promotes the amicable settlement of disputes arising from succession and estate administration through mediation, negotiation, and other alternative dispute resolution mechanisms. Where necessary, it provides technical guidance and support to facilitate lawful resolution in accordance with Uganda's succession laws.

10. Representation of the Administrator General in Court

The Department represents the Administrator General in court proceedings relating to estate administration, succession disputes, trust matters, and other legal issues within the Directorate's mandate. It prepares legal documents, presents evidence where required, and works closely with other legal officers to protect the interests of beneficiaries and uphold the law.

11. Protection of Beneficiaries from Fraudulent Administrators

The Department safeguards beneficiaries against fraud, abuse of office, mismanagement, and other unlawful practices by estate administrators or third parties. It investigates allegations of misconduct, advises beneficiaries on their legal rights, and takes appropriate administrative or legal action to ensure that estates are administered honestly, transparently, and in the best interests of all beneficiaries.

12. Facilitation of the Lawful Distribution of Estates

The Department oversees and facilitates the lawful distribution of estate assets to beneficiaries in accordance with court orders, wills, the Succession Act, and other applicable laws. It ensures that the distribution process is transparent, equitable, and consistent with the rights and interests of all lawful beneficiaries while minimizing disputes and delays.

The Department facilitates the lawful distribution of estate property to beneficiaries in accordance with wills, court decisions, succession laws, and approved estate administration processes. The Department provides legal advice and guidance to beneficiaries, administrators, executors, and members of the public on succession-related matters. This includes advice on estate administration procedures, rights and obligations of beneficiaries and administrators, interpretation of succession laws, preparation of relevant documentation, and available remedies in cases of disputes or unlawful actions.
